ElevateU Terms of Service Agreement

- Introduction
These Terms of Service explains how Midpoint Consulting, Inc., a Wisconsin corporation (“Midpoint,” “we,” “us,” or “our”) collects, uses, and protects your personal information when you use the ElevateU platform.
- 2. Acceptance of Terms
By accessing and using the ElevateU platform, you agree to comply with and be bound by the following Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the ElevateU platform.
- 3. User Accounts
- Account Registration: You must create an account to access the services provided by ElevateU. You agree to provide accurate and complete information during the registration process.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials. You are also responsible for all activities that occur under your account. Notify Midpoint immediately of any unauthorized use of your account.
- 4. License to Use
- Midpoint grants you a non-exclusive, non-transferable, limited license to access and use the ElevateU platform for the purpose of completing the training courses offered.
- You agree not to copy, modify, distribute, sell, or lease any part of the platform or its content without prior written consent from Midpoint.
- 5. User Conduct
- You agree to use ElevateU for lawful purposes only. You must not:
- Post or share any content that is illegal, harmful, or violates any third-party rights.
- Attempt to gain unauthorized access to the platform or its related systems.
- Disrupt or interfere with the security or performance of the platform.
- Intellectual Property
- All content, materials, and intellectual property on the ElevateU platform, including but not limited to text, graphics, logos, and software, are owned by Midpoint or its licensors and are protected by copyright, trademark, and other intellectual property laws.
- You may not use any of the content or materials on the platform for commercial purposes without obtaining a license from Midpoint.
- Termination
- Midpoint reserves the right to suspend or terminate your access to the ElevateU platform at any time, with or without cause, and without prior notice.
- Upon termination, your license to use the platform will cease, and you must stop all use of the platform.
- Disclaimer of Warranties
- The ElevateU platform is provided “as is” and “as available,” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Midpoint does not warrant that the platform will be uninterrupted, secure, or error-free.
- Limitation of Liability
- In no event shall Midpoint be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, loss of data, or other damages arising out of your use or inability to use the ElevateU platform.
- Midpoint’s total liability to you for any claims arising out of or relating to these Terms shall not exceed the amount you paid to use the platform.
- Modifications to the Terms
- Midpoint reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the ElevateU platform. Your continued use of the platform following the posting of changes constitutes your acceptance of those changes.
- Governing Law
- These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law principles.
